in the original idea,
i was on log scale -

so while i was totally onto the idea of the top being in,
i failed to take into account the scale which i was observing this market on.
↕
after a deeper observation into how the spx and the nasdaq move,
i've come to a conclusion that the algorithms which move these two indexes do so on a linear scale.
it could just be an older system, or perhaps there's a deeper reason behind it - maybe one day we'll find out if we randomly meet the human who created "t h e a l g o r i t h m" at a cocktail pawrty.
